Records Retention

Both federal and state laws regulate retention requirements for personnel records. The following tables identify some of the more common records and the federal law regulating retention requirements. Illinois State law record retention requirements are summarized as follows: child labor; wage and hour and workers' compensation records - 3 years; Fair Employment Practices records - 1 year; income tax - 4 years; unemployment insurance and unclaimed wages records - 5 years (reportable as abandoned then 5 years longer after report for 10 years total).
