The three NAFTA customs agencies focus the burden of certification proof on the exporter of record. Although your freight forwarder may complete the NAFTA Certificate of Origin on your behalf, your company is still held liable for the declarations being made on the certificate. Any fines or penalties for incorrect or false certification will be assessed to the exporter of record.

The customs agencies require record keeping and audit trail systems to assure that due diligence has been used in both the certification and documentation processes.

A clear understanding of the NAFTA Certificate of Origin requirements will help you verify that your suppliers’ goods qualify as NAFTA originating materials. In turn, you can ensure NAFTA’s preferential treatment for your customers.
