COVID-19 Sanction Appeal Hearing Procedures

Purpose

The purpose of a COVID-19 Sanction Appeal Hearing at Bradley University is to hear and review sanctions for which students or student organizations have been charged with violating the University’s Standards of Conduct and policies as they relate to COVID-19.

Rights and Responsibilities

  • Students or student organizations who have been charged with violating a standard of conduct related to COVID-19 will be given fair and objective consideration.
  • Students or student organizations who have been charged may present information about the incident at the appeal.
  • Student or student organizations may submit via email (through vpsa@bradley.edu) any evidence, witness statements, or information they would like the Appeal Panel to consider a minimum of 72 hours prior to the hearing.
  • Student or student organization have the right to be accompanied by an advisor of their choosing. The advisor may be an administrative official, faculty or staff member, parent, organization advisor or student, but may not serve in a legal capacity. Advisors are not allowed to address the Appeal Panel.

Composition of the Appeal Panel

The appeal panel is comprised of three members:

  • a student who is typically a member of the Student Arbitration Board.
  • a university staff member who serves as the coordinator
  • a university faculty member

Process

COVID-19 Sanction Appeal Hearings will be held virtually. Appeal Panels members will introduce themselves, Students or Student Organizations will introduce themselves and present any verbal evidence or opening statement they would like to make. The Appeal Panel will ask any questions they deem relevant. Students or Student Organizations will provide any closing statement they would like to make. The Student or Student Organization will exit the meeting. The Appeal Panel will determine the outcome of the hearing. The outcome will be communicated to the Student or Student Organization via an email from vpsa@bradley.edu.

Potential Outcomes for Students or Student Organizations

The Appeal Panel may:

  • Remove the sanction imposed by the COVID-19 Conduct Violation Review Team
  • Amend the sanction imposed by the COVID-19 Conduct Violation Review Team
  • Uphold the sanction imposed by the COVID-19 Conduct Violation Review Team

Appeal Decisions

Decisions made by the Appeal Panel will be based on evidence; with consideration for the health and safety of other members of the Bradley and the Peoria community; and university policy. The Appeal Panel will take into consideration the impact of the behavior, prior conduct history and willingness to make necessary changes.

Appeal Hearing Panel decisions are considered final without further recourse within the University.
